The Code of Criminal Procedure, 1973 (Cr.P.c.) section 1



1. Short title, extent and commencement

(1) This Act may be called the Code of Criminal Procedure, 1973.

(2) It extends to the entire of India.

Provided that the provisions of this Code, aside from those concerning Chapters VIII, X and XI thereof, shall not apply-

(a) to the State of Nagaland,

(b) to the tribal areas,

but the concerned government may , by notification apply such provisions or any of them to the entire or a part of the State of Nagaland or such tribal areas, as the case could also be , with such supplemental, incidental or consequential modifications, as could also be laid out in the notification.

Explanation.- during this section, “tribal areas” means the territories which immediately before the 21st day of January, 1972, were included within the tribal areas of Assam, as mentioned in paragraph 20 of the Sixth Schedule to the Constitution, aside from those within the local limits of the municipality of Shillong.

(3) It shall inherit force on the first day of April, 1974.

(१) इस अधिनियम को दंड प्रक्रिया संहिता, १९७३ कहा जा सकता है।

(२) यह पूरे भारत में फैला हुआ है।

बशर्ते कि इस संहिता के प्रावधान, इसके अध्याय आठवीं, दसवीं और ग्यारहवीं से अलग, लागू नहीं होंगे-

(ए) नागालैंड राज्य के लिए,

(बी) आदिवासी क्षेत्रों के लिए,

लेकिन संबंधित सरकार, अधिसूचना द्वारा, ऐसे प्रावधान या उनमें से किसी को भी पूरे नागालैंड राज्य या ऐसे आदिवासी क्षेत्रों में लागू कर सकती है, जैसा भी मामला हो, ऐसे पूरक, आकस्मिक या परिणामी संशोधनों के साथ, जैसा भी हो सकता है अधिसूचना में निर्धारित किया जाए।

स्पष्टीकरण - इस धारा के दौरान, "जनजातीय क्षेत्रों" का अर्थ उन क्षेत्रों से है जो 21 जनवरी, 1972 के ठीक पहले असम के जनजातीय क्षेत्रों में शामिल थे, जैसा कि संविधान की छठी अनुसूची के पैरा 20 में वर्णित है, उन क्षेत्रों से अलग शिलांग नगर पालिका की स्थानीय सीमा के भीतर।

(३) यह अप्रैल, 1974 के पहले दिन को बल प्राप्त करेगा।
